Terms of Service

1. Who you are contracting with

These terms form an agreement between you and:

By creating an account or using Jabbly, you agree to these terms.

2. The service

Jabbly is an all-in-one platform for creators to build platforms and pages, sell digital products and online courses, send newsletters and drip campaigns, run webinars, create tracked shortlinks, and manage subscribers and comments in one connected place. Features may change, improve or be retired over time.

3. Accounts

• You must be at least 16 years old and able to enter a binding contract.
• You are responsible for your login details and everything that happens under your account.
• Provide accurate details and keep them up to date.

4. Plans, billing and trials

• Paid plans are billed in advance on a recurring monthly basis and renew automatically until cancelled.
• Trials are free for the stated period. If you do not cancel before it ends, the plan continues as paid.
• Prices are shown excluding VAT unless stated otherwise. VAT is added where legally required.
• You can cancel at any time; your plan stays active until the end of the paid period. Fees already paid are non-refundable except where required by law.
• Payment processing fees charged by Stripe are separate from your Jabbly plan.

5. Your content

You keep all rights to the content you upload, create and sell. You grant us a limited licence to host, store, process and display it solely to operate the service. You are responsible for having the rights to your content and for what you sell.

6. Your customers and subscribers

You are the seller of record for your products towards your buyers and are responsible for your own product descriptions, delivery, support, refund policy, consumer rights information and taxes. You are also responsible for having permission to email the people on your list and for honouring unsubscribes.

7. Acceptable use

You may not use Jabbly to:

• Send spam or buy, scrape or rent email lists
• Publish or sell illegal, infringing, deceptive, hateful or sexually exploitative material
• Run scams, pyramid schemes or misleading income claims
• Distribute malware, phishing links or attempt to breach the platform's security
• Resell or reverse engineer the service, or overload it with automated requests

8. Suspension and termination

We may suspend or terminate your account if you breach these terms, if payment fails, or if your use creates legal or security risk. You can close your account at any time. On termination we delete your data as described in the Privacy Policy.

9. Availability

We work to keep Jabbly available and reliable, but the service is provided "as is" without a guaranteed uptime level. Maintenance, updates or third-party outages may cause interruptions.

10. Liability

To the extent permitted by law, our total liability in any 12-month period is limited to the amount you paid us in that period. We are not liable for indirect or consequential loss, including lost profits, lost revenue, lost sales or lost data. Nothing here limits liability for intent or gross negligence, or for rights you have as a consumer under Dutch law.

11. Privacy

Our Privacy Policy explains how we handle personal data and applies as part of these terms.

12. Changes to these terms

We may update these terms. We will notify you of material changes by email or in the app at least 30 days in advance. Continuing to use Jabbly after the change means you accept the new terms.

13. Governing law

These terms are governed by the laws of The Netherlands. Disputes will be submitted to the competent court in the district where Jabbly is established, unless mandatory law says otherwise.
